We went many years with a very simple one page contract telling our providers that we kept it simple because if it wasn’t working for them, it wasn’t working for us either. But that didn’t really work either. Over the years we took on many accounts that just didn’t work out well for us. As we gained experience we realized that some of them didn’t work out well because we didn’t identify in our contract what we expected from our providers. We couldn’t go back to them and point out in their contract that they promised that they would do this or that. It was a problem when they didn’t send us notification of all the payments they received as it caused us much extra work but the contract didn’t state that they would send us payment information in a timely manner. We did not even spell out what the penalty was if they didn’t pay on time.

In fact when we started our medical billing business in 1994 we charged a percentage of what we collected from the insurance companies which is illegal in New York State. The accountant of one our new accounts notified us of the illegality of this. When we showed it to our attorney he explained that because we were breaking the law with this contract it was completely null and void and nothing in it would hold up in court so we might as well not have had a contract. You can avoid many future problems and lost work by protecting yourself with a comprehensive contract.  And you don’t have to pay a lot of money for it.
