Hello everyone.  I hope someone can help.  I'm going to make a long story short.  I need to know how you can find out who is accessing my medical records and my daughters.  My husband and I have been dealing with an old exgirlfriend of his who stocks us.  She is a medical biller.  I was told by a very reliable source she has been accessing my daughters health records.  I also believe she is accessing mine. Can someone please tell me how to find out if her or the company she works for has been accessing them?  I feel very violated!!!!  She has no reason to look at them.......... How do I go about finding out who is in my business?  I hope someone can give me some advice... Thanks for listening...... >:(

You need to contact the provider's office where she is gaining access to the records.  Even if she is the biller, she has no right to access your (or your daughter's) records.  You need to ask them who the "HIPAA Compliance Officer" is because this is a HIPAA violation.  The office should have one.  If there are less than 10 employees and they don't bill electronically then they may not.  Hoping they do, ask how you can speak to that person.  You may want to go in person (if not possible to go in person you can call).  Advise that person that you want to file a complaint.  You know that this person has been accessing your personal health information and you want to know what they are going to do to 1. make sure it stops and 2. discipline the person.  If you do not get a satisfactory answer, or you don't feel that they are acting on it, then you can file a complaint.  The following link gives you info on how to file a complaint, but you should contact the provider's office first.  Give them a chance to rectify the situation.  They need to know who they are giving access of records to.  She may have others that she is stalking as well.

Most facilities that have EMR utilize a system where it leaves an electronic trail of anyone who views patient records. I agree with Michele, contact the provider she works for.  I had access working at the hospital to a lot of clients records, but they run reports on excessive use. Even when I worked at a private facility, we were associated with a Major hospital and could go online to get medical records, but they could only be our patients. That information is tracked also. Paper trails are harder to prove, but EMR can surely pinpoint date time and accessed information.

Thank you so much michelle and charlene.  That is what I wanted to know who is accessing my medical records or my daughters and if is tracked.  I'm going to file a complaint with my states office of civil rights and ask to see who all is accessing it.  I know for sure she accessed it somewhere around nov 07 to jan 08.  That is how she found out who my daughters doctor was amoung other info...I don't think she looks often and doesn't want to raise suspicion at her job but I think if she did it once she'll do it again. I want to make sure she is not in mine as well.  All I can say is I'm really glad we have hipaa!!!!!!!!!!
