Hello,

New to the forum, trying to get some input from others in the industry on lab billing/draws done in Internal Medicine office. We have a good relationship with a local laboratory here in the area, we went to refer to them as much as possible and still have it be beneficial for both parties.

They would provide & pay the phlebotomist. This person would come to our office 1-2 days a week to do lab draws for all our patients. The specimens would be processed by this laboratory. We would bill under our NPI for the lab(s) ordered, once reimbursed for these labs we would pay a portion to the laboratory.

I guess my question is...does anyone have any experience in this? This should not violate Stark Law and I don't believe we need to adhere to any CLIA lab certifications (because blood will not be processed here, just drawn). Any input would be appreciated!

I would verify with a qualified healthcare attorney when it comes to interpretating Stark Laws.
