Hi,
I do billing for a surgeon; I bill as new pt ; it is decided the pt will have surgery; the Dr sees the pt later for a pre op; my question is can I bill for E/M prior to surgery?

Was the surgery performed the same day? You certainly can bill the E/M but the carriers may bundle it in with the surgery. It will depend on the insurance/plan.

Let me rephrase: Dr sees the pt and I bill with a new pt E/M code; at that visit it is decided the pt will have surgery at a future date; the pt returns for a pre op visit for surgery scheduled on another day; my question is can I bill an E/M for the pre op and which code would be appropriate.

Yes, the Doctor can bill for the pre-op appointment. 99212, 213 o4 214 depending on what criteria is met.
