Notice of Privacy Practice and Business Associate Agreement

Good Afternoon,

I am not sure if this is the right place to ask this, but any help would be greatly appreciated.  If a practice has been open for a while,more then 10 years, but has nevery done Business Associate Agreements or given their patients Notice of Private Practice Aknowledgment forms, can they still do so now? I am thinking yes they should but I just would like to make sure because the Business Associate Agreement had a specific deadline.

Also, there are new BAA and NOPP that have to do with the Omnibus Rule. Are these the newest forms or are there newer forms?

I'd say it's never too late and If I were them I'd probably invest in some lottery tickets since they seemed to be lucky not having any problems with not having an NPP or BA agreements!!

You'll want to make sure they are both HIPAA and HITECH ready to include Breach Notification rules.

I know :-( Unfortunately where I live, things work a little differently here.  I am trying to get things together.

Let me guess(going to stereotype here)are you in a rural/Southern area, or both? Every provider I have ever billed for in one or both of those areas of the U.S. was just seriously behind the curve on compliance/billing/coding issues.

Why is that? If that is the case instead of a medical billing company I might be more inclined to start a prison jumpsuit business in that area!
