NON ADA Compliant Office?

I have a LCSW who is moving her practice into an older- non ADA compliant building. No wheelchair ramp, no handicapped bathroom, etc.

will this pose a problem with the insurance companies?  Medicare/ Medicaid?

Does the provider participate with insurance?  Medicare?  Medicaid?  This is from the CMS website:

Title III of the ADA applies to certain categories of private entities known as “places of
public accommodation.” The definition of such places includes a “professional office of a
health care provider, hospital, or other service establishment.”  With certain limitations,
Title III and its regulations require medical providers to provide equal services to
individuals with disabilities, to make reasonable modifications in policies and practices
where necessary to provide equal access, and to provide auxiliary aids and services
when necessary to provide effective communication. Title III also requires removal of
architectural barriers at existing facilities where barrier removal is readily achievable, and
compliance with the ADA Standards for Accessible Design for new construction and
alterations to existing facilities.

I believe if she is in network with any state or federal plans she has to be ADA compliant.

I am hoping Linda sees this post as she is more versed in legal matters.

I have been researching this and it appears that if an office is not ADA accessible and it's not financially feasible to update an older building, alternative accommodations can be made.  In the case of LCSW- therapy can be provided at another location or via telehealth.

She is on NYS Medicaid (Beacon) and Medicare. But neither covers telehealth- is that correct?

I do not believe NYS Medicaid covers telehealth yet.  Medicare does cover telehealth for certain situations:

thank you Michele!  I was just looking online at the list of local Beacon (MVP Medicaid) providers and see some have the wheelchair icon and some do not. So, I am guessing non accessible is ok as far as them.
