Client has a a credit on account but...

She also has a $100 no show fee for her last visit. 

The provider wants me to take all her available credits (insurance paid at 100% after she paid her OOP in full) and apply toward the no show fee and send her a check for the remaining credit.  the provider never noticed credits building up, that's why she has so many.  She has about $118 in credit but owes $100 for unpaid no show fee.

I feel like I should have to refund her the credit and hope she pays the no show fee.  I highly doubt she will, because that's just how most people are.

Legally, am I obligated to refund those credits and the practitioner just has to bite the no show fee?

If patient signed off on paperwork that shows information on no show fees, then you can.  we had an issue like this come up before, but check your state laws as well.  in my state, we can do this as it is considered a "fee"
