HIPAA and Call recording.

Hello Everyone!!

I need your help on the following scenario. While calling the payers to discuss a claim, is it mandatory under HIPAA to inform the payer representative that the call is recorded for quality and training purposes?

As the biller being the business associate and payer being a covered entity I feel the disclaimer is not mandatory. I would appreciate your thoughts in this regard. Thank you.

I think federal and state laws about recording phone calls trumps HIPAA in this situation, but I am no lawyer.

YES.

Carriers already make that dislaimer .. if you are a providers office or facility, absolutely you must inform all callers that calls are being recorded for quality. It would fall under TPO for HIPAA.
