Psychotherapy over the phone

Can anyone tell me if LCSW/Ph.D. are allowed to provider psychotherapy over the phone?  I know this not billable to insurances and our clients pay out of pocket but during our site survey I was told this was not allowed even though I know of other clinics that do it as well.

I don't believe there is any law that says that a provider cannot speak to a patient over the phone.  As you stated, many insurance carriers do not cover it as a benefit, although many are now starting to allow telemedicine but it must be done using a service that allows face to face.  The patient must be aware that the service is not covered under their insurance plan and that they will be responsible for the charge.
