Michele,
I was thinking we all talked about charging % and how it is considered fee-splitting, but I was wondering if I go after DME suppliers do you think % would still be a problem if they are not doctors?

I'm going to say yes, but you should talk to an attorney. Some states will state something to the effect that: "Permitting any person to share in the fees for professional
 services, other than: a partner, employee, associate in a professional firm or corporation,
professional subcontractor or consultant authorized to practice medicine, or a legally
 authorized trainee practicing under the supervision of a licensee. This prohibition
shall include any arrangement or agreement whereby the amount received in
 payment for furnishing space, facilities, equipment or personnel services used
by a licensee constitutes a percentage of, or is otherwise dependent upon,
the income or receipts of the licensee from such practice, except as otherwise
provided by law with respect to a facility licensed pursuant to


Thats a clip from NY as example.

My advice is just not to do it. There are many other means of invoicing your clients and it's always better to be safe than sorry, and again, consult an attorney.

It is very hard to figure on how to charge a supplier a flat rate and how to word it in a contract, can you give me a example of how to word or figure this out.
