: Fee Splitting
: ljones88 September 28, 2015, 10:48:18 PM
I've searched the forums and haven't quite found the answer to my question. I understand that physicians cannot participate in fee splitting in some states. Florida has a law against fee splitting, however, after speaking to other Florida billing service companies most of them do charge a percentage per claim paid amount. I think I may be misunderstanding the fee splitting issue. Can someone point me to a possible site that can further explain this?

I don't know of any specific website for FL but I have read this one for NY which breaks it down nicely:  https://www.kirschenbaumesq.com/article/paying-a-billing-company-or-biller-a-percentage-a-no-no

I know this is for NY but I think it is the same basically for FL.

Florida indeed is another state where the law is very clear and concise. PMRNC has an area with case precedences and the full state statutes available. www.billerswebsite.com

For Florida:  prohibits "paying or receiving any commission,
bonus, kickback, or rebate, or engaging in any split-fee arrangement in any form whatsoever with a physician, organization, agency, or person, either directly or indirectly, for patients referred to providers of health care goods and services . . .

Florida actually has the most case precedences on record.
