Good Morning,
I am in the process of starting up my own billing business and I was confused with the contract and business associate agreements. Are these two one of the same thing?
I have 2 doctors that will be coming on. I know that I will have to get a contract done, but will that take place of the Business Associate Agreement? Or is the Business Associate Agreement something they give to me?
Any help will be greatly appreciated.

The contract and BAA are two separate documents. The BAA is technically the responsibility of the provider, however most are unaware. We have one that we offer to our providers. It is for HIPAA purposes. You should have both available and then ask the provider if they have one or if they want to use yours. Contracts are very personal and need to be specific for your business but BAAs are more generic. Just verifying that you have practices in place to protect PHI.

Thank you Michelle! With all the research I have been doing it was still very confusing to me, but you clarified it for me. And thanks for adding in whether or not I was supposed to provide the BAA or the provider.

If they don't provide it, then your not in compliance so "who" is supposed to provide it really isn't even a factor. You just want to make sure you have one.
