Recoupment and Documentation

I have a couple questions that I am having a hard time finding out the answers to.

In several cases whether it be Medicare or a Private Payor, we have asked them to recoup payment when we have discovered an overage. What documentation of this do we need to keep?  How long do payors have to recoup the payment before the statute of limitations runs out?  Also, where does the burden lie if Medicare for example does not recoup the payment and we know this?

Thanks for any help.  We have moved from a Incorporation to an LLC and have these accounts set up for refund waiting on recoupment in our Inc account.  We need to know do we just need to cut a check or what.  Also, some date back to 2009 and 2010.
