Hello. Quick question... In my Business Associate Agreement, is my company the covered entity or the provider? I read a few different things online so I'm confused. At the moment, I am writing it so that I am the covered entity, but I am halfway through and began to doubt myself.  Thank you for your help in advance!  ::)

or doesn't is matter as long as the wording coordinates with what ever I choose to call myself?

It really depends on the services you provide. MOST outsourced billing companies are considered Business Agent's but there are a few who are considered covered entities

So here is an example of what I was doing

This Business Associate Agreement (“Agreement”) is entered into on this day of __________________, 20___ (the ”Effective Date”), between MedPro Medical Billing Service (“MedPro MBS”) (“Covered Entity”) and ________________________________________(“Business Associate”) (each a “Party” and collectively the “Parties”).

WHEREAS, Business Associate will disclose and/or make available to Covered Entity  Protected Health Information (“PHI”) in connection with services provided to Business Associate by Covered Entity, which information is confidential and must be given special protection; and

WHEREAS, Covered Entity will have access to and/or create on behalf of and/or receive from Business Associate PHI that can be used or disclosed only in accordance with this Agreement and the HHS Privacy Standards Rule;


So that's not right and I have to change it, correct?  Basically I just have to switch covered entity and BA making me the BA?  Thank you for your help....
