Work Comp OV coding

It is my understanding that with work injuries - every new injury is billed with the new patient E&M codes.
Is this correct?  I have an insurance carrier saying this is wrong.....HELP

New injury / New exam.  Send your Dr.s' 1st Report with the billing and they must pay it (if you are the PTP and do a Dr.s' 1st).  You should bill an established patient visit each time you do a PR-2 as well, they may not pay that, though, if you also did treatment.  (Depends on what kind of office you are, if you are primary or secondary, and of course what your state rules are)

The E/M codes w/b fine unless the carrier is asking for 99455?
