Legally that his incorrect, an HSA is a separate account and depends on whether it is contributory or fully funded by employer, in which case it's the employer but ultimately it is not a part of the insurance plan. Market plan's did allow patient to open up eligible HDHP plans, but again this is not an insurance payment and is still controlled by the patient. What my clients do is ask patient if they have one and if they would like it billed and have them complete a separate assignment of benefits. Some HSA's will require the patient to draw the money to give the provider.  When you verify benefits, the carrier really doesn't give you info on an actual HSA, there could be something else but legally speaking the carrier does not maintain control over an employer or contributory HSA.
