E/m with Theraputic exercise

Same problem child Physician did an office visit with  therapeutic exercise (97110)

Do I bill the OC with a mod 25 and then the 97110?  He thinks the 97110 should have a mod 59(I do not.

REALLY appreciating you guys right now!!!

If he feels that the OC was a separate & distinct service then I would use the 25 on the OC but I would not use the 59 on the 97110 (assuming they are the only two codes on the claim).
