Advanced Data Systems (ADS)- Charging against contract

<< < (2/2)

I would fight them on this. They can't just scratch out parts of the contract, and change dates on it, etc, without your knowledge and your signature showing you agree to the changes. That totally defeats the purpose of a written contract!

I had something kind of similar happen a few years ago with the company we use as the vendor/support for our software Medisoft. We sign a yearly contract with them. We got a new account rep, and she went through our account, and realized that the former account rep hadn't charged us for an upgrade that they said was free, when it apparently wasn't, AND that they hadn't been charging us a "per provider" fee to submit electronic claims, but just one flat monthly fee, for the past two years. By her estimation, we owed the company over $3500 for THEIR mistakes.

Uh, no. None of this was in our current or former contracts, and there was no way we were paying them this money. Which is what I told her, in writing, and said if they pursued it, we would get our lawyer involved. They dropped it completely. When our new contract came up, the "per provider" fee was added moving forward, and I was fine with that. But there was no way we were going to pay for something that wasn't in the previous contracts.

I would rather pay a lawyer to fight this for me if I was you (assuming it doesn't get outrageously expensive) , and win, and be completely done with this company you are dealing with.

Can you get all accounts out and be done with them?  I agree with Kristen, I would fight this.  It seems extremely unfair but as long as you have clients in there they have you over a barrel.
