If Medicare is denying for the discharge date then I would use the end date for the service on the claim.  Even though technically they are not discharged, the end of the service you are billing for on that claim is the date of the service so I would use that.

Example:

Billing for services for today, 7/13/09, I would put 7/13/09 for the discharge date.
