Billing for supervision

I’m so glad you are all here I need help with a BIG question.

I have an office that would like me to bill for a provider that is not licensed in NJ she is working on her hours to get her NJ license she is a LCSW holds a license in a different state.
She is being supervised by a provider and they are telling me to bill under his name he is not in the room with her at the time of services. Reviews the cases with her at a different time.
Can you bill under him or not?

This is kind of hard to answer based on the info you've given.

What are the credentials of the other provider?  If it is another LCSW the answer is absolutely not.  If it is an MD or a PhD or a PsyD, then you need to check the state laws and the guidelines of each insurance carrier.  Also, even if the other provider is not in the room, is the LCSW going over the cases with the other provider after the services were rendered?  The supervising provider doesn't necessarily have to be present during therapy, but there would be other guidelines, such as reviewing the care, etc.  If the other provider is not truly supervising but just providing a means for billing to get paid, this is a big no-no.  

If the LCSW is required to work so many supervised hours to get the license, and the other provider qualifies as a supervising provider then it may be fine.

I have to add to this.. I had a provider who was supposed to be supervising, I was NOT made aware of the situation (no idea) until they tripped up and sent me daysheets when I knew the provider was away on a fishing trip. This was few years ago, I had heck of a time with this provider and following rules, but this was my last straw, from what I understand big time sanctions were handed down and I got a whistleblowers check a few years later (definitely not a big one.. ) my point is that you should be given something to COVER yourself on the arrangement (credentials, licensing, etc)  the reason I had to turn this provider in was because by law.. ONCE I became aware of the situation it was my neck on the line.  It was the same situation you are referring to, only he was a PhD and was supposed to be ON SITE.. once I found out and did some homework I found out a lot of this was going on and I had NO choice but to cover myself and report it.
