If a DME product denies non covered CO96 denial code. Can we bill the patient for this we have had them sign a waiver made from our office or is this a provider W/O?

Michele:
Is your waiver an ABN?

mstilger:
No its not an ABN. Its a DME form that our office made up that shows that this is a non covered item per DSHS and they have the patient sign this thinking we are able to bill after the denial. I thought you could not bill a DSHS patient know matter what. We are sending these patients to collections.

PMRNC:
For Medicare you have to have an ABN, but for other carriers including Medicaid you have to take a look at the contract. Some states won't allow you to bill the patient if they are on Medicaid.
