billed for being asked a question by the Doctor

I recently received an EIB for a recent Dr. visit. It had a charge for some smoking cessation level 3, something or other, for $38. Well when I called to question this, because there was no smoking cessation discussion, here is what I was told. Because the doctor asked me if I smoke and because I answered yes, I could be billed for this. Because according tho them this was considered a discussion about smoking.  My insurance won't cover this either. So my question is can I be billed because the doctor asked me a question?

Where did you call the doctor or your carrier?  DID you receive a bill? did the EOB say anything about patient responsibility? It could be a matter of a charge ONLY if you access the smoking cessation programs available. I"m not really sure. I would call the doctor to see if you were charged.
