1. The ruling under discussion is a narrowly-focused ruling, specifically with regard to the Federal Medicaid program - which is a program operated jointly by the Federal and State governments.  Which means that both Federal and State regulations are involved in administering the program in any given State.

2. State law may not supersede Federal law - except in cases where the State law is more strict than Federal law.

This ruling said only one thing:  Federal law does not prohibit a doctor from hiring an outside biller and paying them a percentage of the money they bring in.

That is true nationwide.  The only reason that percentage billing would be illegal in a particular State is if that State passed a law saying it was illegal.  Since that position is stricter than the Federal position, it would be allowed to stand.

So yeah - the ruling linked to at the top of this thread has nothing to say about what individual States may do through their business codes.  That ruling only clarified that the Federal government does not make percentage billing for medical billings illegal.  It is up to the States to do that.

So - not only did the ruling not change anything on the larger scale (it would be up to the individual States to do that), it did not change anything on the smaller scale either (in California).  It simply reminded one Federal jurisdiction in California of what was already true.  Remember from the case narrative that one Federal jurisdiction blocked the doctor while a different Federal jurisdiction did not - presumably because they did not need to be reminded of what the Federal regulation actually said.
