We are in the state of Va. If the work comp carrier has place the claim in an investigation status can we make the patient pay self pay for visits until they deem it work related and start paying on the bills?
We have one patient that came to us as a work comp she fell at work with loss of consciousness but bystanders says they witnessed seizure activity, according to records. Work comp is likely going to deny this as comp. Can we legally do follow ups as self pay until they make a determination

I'm not sure of the VA laws, but in NY you cannot accept a patient as comp and then make them pay. Unfortunately if they come to you as comp, and you agree to treat as comp and bill the comp carrier, you can't make them pay up front. You can make them sign a statement that if it is declared not work related then they will be responsible.

We make sure to get the WC info, adjusters name, etc. If there is attorney we also get an LOP. MOST likely since you are referencing witnesses, this is an open case and an attorney is involved (safe bet). Make sure to get the LOP. I do mental health and we see a lot of sexual harrassment go in as WC but patient's don't file it that way, in which case we tell them they are responsible for payment unless there is an open case.
