Hello there,
Hope all is well. How do I find out if in the state of CT if you can charge for your billing by percentage or flat fee ? thank you.

I am not sure where you can check but I would encourage you to consider another method.  In certain states it is illegal, NY FL IL, but in many states it is a gray area.  In NY the OAG actually charged both providers and billing services who had percentage based contracts.  Being that it is the government many felt they had to pay fees because trying to fight would have been even more costly.  It is just better if it is even a question to not go there.  Unless you live in a state like CA where they specifically have a law that allows percentage based billing.  NY has a bill on the Senate floor but it's stalled so who knows if it will ever pass.

Fee splitting laws and prohibition of fee-spliting is on the provider, however with that said, billing companies in those states that do prohibit fee-splitting could put their contract in jeapordy and the license of their client(s).

We have been doing extensive research on these states for years and we continue to update- our members only area has all the states we've identified to have fee-splitting laws on the books. Als there are only 17 states to which have NO fee-splitting laws and that includes "Medicaid" There are still 33 states where fee-splitting by medical providers is probhited under Medicaid.
In NY while it's clear it's state law it's also against NY Medicaid rules so Medicaid in NY for the past 18 months is actually sending letters to bililng companies and doctors alike attempting to recoup these funds. A few of our members have seen this letter despite knowing NY has had a fee-splitting law for a very long time.

I charge hourly rate with sliding scale + expenses. This way I get paid for everything I do.
