Legal Arrangement to avoid fee splitting in Florida?
« on: February 20, 2020, 12:12:04 PM »
Hi Everyone, I own a medical weight loss practice in Florida.  I'm considering bringing in an acupuncturist to perform services for our patients.  The acupuncturist will be an independent contractor.  I will supply her with an exam room and scheduling software, but that's about it.  We (the medical practice) are out-of-network; we don't take any insurance or medicare.  The acupuncturist is in network and will do her own billing for the services.  To avoid fee-splitting and anti-kickback rules, I am going to simply charge her a rental fee for the space regardless what she charges the patients or bills insurance.  Does that sound kosher?

Sounds like a decent plan to me.  I would elaborate but there's really not much to say.  You've covered all your bases.  :)
