Medical claim submission

The physician is out of network and a new patent's out of network insurance plan has a $6000 deductible - to date, nothing has been met. She does not want to use her HSA for any deductibles applied to the claims submitted. Are we obligated to send a claim in this case? Does she have to use her HSA? Thanks

An HSA is voluntary so no your not obligated, but patient is still obligated to pay her out of pocket so you should be collecting up front or at least have her set up on a payment plan.
